UK: Marriage Visa

A marriage visa for UK is generally issued to a spouse, civil partner like a husband or a wife to apply for immigration to UK on the basis of their legal marriage with a person who has a permanent residence status or a citizenship in the UK. This visa lets the applicant leave or enter UK for an indefinite period of time until the citizenship or permanent resident status is granted to the applicant. This visa allows the applicant to be settled in the UK. Settled status means that you are living in the UK lawfully with no time limit on your stay. The preliminary time period for which the marriage visa is issued varies with different cases. Initially visas for spouse immigration are issued for a two year period. After this time, a person can apply for an indefinite leave to remain- commonly known as permanent residency in the UK.  The benefits of getting a marriage visa are many. The applicant can seek employment in the United Kingdom without the need of any work permit. Neither there would be any restrictions placed on the type of work that would be undertaken by the applicant in the UK. The main eligibility criteria to qualify for a marriage visas are-
  • The age of the applicant and the sponsorer applying for a marriage visa should be over 21 years. This new age rule has been put in service with the effect of rules for marriage visas on 27th November 2008.
  • The relationship of married partners must fulfil the requirements of a Legal Marriage by providing enough documentation proofs. They should be planning to live together; they have met each other and have a genuine relationship.
  • They should have sufficient funds to support their stay in the UK. They should also have enough accommodation to accommodate any dependents with them.
  • Dependents would be allowed to accompany their parents on a marriage visa if they are under 18 years of age; are not previously married and are dependent on their parents. The dependent visa is initially granted for a total of 3 years and later they can apply for British naturalization to get the citizenship of the UK.
